Terms of Use

These Terms of Use ("Terms") govern your access to and use of Adultify, including the Adultify mobile application, website, and related services (collectively, the "Services").

Adultify is operated by Empathy Labs, Inc., a Delaware corporation ("Adultify," "we," "us," or "our").

By creating an account, purchasing a subscription, or otherwise accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, do not use the Services.

1. About Adultify

Adultify is a service designed to help parents and guardians better understand and support their child's preparation for adulthood.

Adultify may provide questions, assessments, readiness scores, educational information, recommendations, conversation ideas, suggested activities, personalized content, and other tools related to areas such as education, career readiness, financial literacy, executive functioning, relationships, independence, physical health, and mental health.

Adultify is intended to provide educational and informational support to parents. It does not guarantee any particular outcome for a child.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an Adultify account.

Adultify is designed for parents, guardians, and other authorized adults. It is not intended for children to create accounts or directly use the Services as account holders.

If you provide information about a child, you represent that you are the child's parent or legal guardian, or that you otherwise have the legal right and authority to provide that information to Adultify.

Adultify is currently intended for users in the United States.

3. Your Account

You may be required to create an account to use some or all Adultify features.

You agree to:

Provide accurate and current account information
Keep your login credentials secure
Not share access to your account with unauthorized persons
Promptly notify us if you believe your account has been accessed without authorization
Accept responsibility for activity occurring through your account to the extent permitted by law

You may not impersonate another person, create an account using another person's information without permission, or use the Services for fraudulent or unlawful purposes.

We may suspend or terminate accounts that violate these Terms, create security risks, or misuse the Services.

4. Information About Your Child

Adultify allows you to provide information about your child, which may include a first name or nickname, grade level, your answers to questions about your child, notes, saved items, and other information.

You are responsible for deciding what information to provide.

Because some Adultify features may involve areas such as health, relationships, behavior, finances, or mental well-being, we encourage you not to provide information that is unnecessary for the feature you are using.

You represent that you have the right to provide information about your child to Adultify.

Our collection and use of personal information is described in our Privacy Policy.

5. Adultify Assessments and Readiness Scores

Adultify may calculate scores, ratings, assessments, or other indicators intended to help you think about your child's preparation for adulthood.

These results are based on information you provide and on Adultify's scoring systems, content, and methodologies.

Adultify readiness scores are not objective measurements or guarantees of a child's abilities, development, future success, or actual readiness for adulthood.

Scores and recommendations may be incomplete or inaccurate because, among other reasons:

They rely on information provided by you
You may not know the answer to every question
A child's abilities may differ depending on the situation
Readiness for adulthood cannot be fully measured through an application
Adultify's methodology involves judgments and assumptions
Individual circumstances vary substantially

Adultify should be used as one source of information, not as the sole basis for important decisions about your child.

6. Artificial Intelligence

Some Adultify features may use artificial intelligence or machine-learning systems provided by Adultify or third-party service providers.

Artificial intelligence may be used to generate or help generate recommendations, explanations, summaries, questions, suggested conversations, activities, or other content.

You understand that AI-generated content may:

Be inaccurate
Be incomplete
Be outdated
Misinterpret information you provide
Produce results that are inappropriate for your particular circumstances
Produce different results from the same or similar information

You should use your own judgment when relying on AI-generated content and independently verify information when appropriate.

Adultify does not guarantee that AI-generated content is correct or appropriate for you or your child.

Information submitted to AI-powered features may be processed by third-party AI service providers as described in our Privacy Policy.

7. Not Professional Advice

Adultify provides educational and informational content only.

Nothing provided through Adultify is intended to constitute or replace professional:

Medical advice
Mental health advice
Psychological assessment or treatment
Financial advice
Investment advice
Tax advice
Legal advice
Educational diagnosis
Career counseling
Therapy or counseling

Adultify does not diagnose physical health conditions, mental health conditions, learning disabilities, developmental conditions, or any other medical or psychological condition.

You should consult an appropriately qualified professional when professional advice is needed.

Adultify is not an emergency service. If you believe you or another person is experiencing a medical or mental health emergency or is in immediate danger, contact 911 or another appropriate emergency service.

8. Subscriptions and Payments

Some Adultify features require a paid subscription.

The price, billing period, and features included with a subscription will be disclosed before you purchase it.

Payments may be processed by third-party payment providers such as Stripe. Adultify does not directly store your complete credit-card information.

Automatic Renewal

If you purchase an automatically renewing subscription, your subscription will continue and your payment method will be charged at the applicable recurring price unless you cancel before the next renewal date.

The applicable billing period, price, and renewal terms will be shown to you before you purchase a subscription.

Cancellation

You may cancel your subscription using the cancellation method provided through Adultify or through the applicable payment or purchasing platform.

Cancellation prevents future renewal charges. Unless otherwise stated or required by law, cancellation normally takes effect at the end of your then-current paid subscription period, and you may continue using paid features until that period ends.

Deleting the Adultify app from your device does not by itself cancel a paid subscription.

Free Trials and Promotional Offers

Adultify may offer free trials, introductory pricing, discounts, or other promotions.

If a free trial automatically converts into a paid subscription, we will disclose the applicable price and renewal terms when you enroll.

Unless you cancel before the end of the trial period, your payment method may be charged for the subscription at the disclosed price.

Promotional offers may be subject to additional terms and eligibility requirements.

Refunds

Except where required by law or otherwise expressly stated at the time of purchase, subscription payments are nonrefundable and we do not provide prorated refunds for unused portions of a subscription period.

Nothing in these Terms limits any refund or cancellation rights you may have under applicable law.

Price Changes

We may change subscription prices in the future. Price changes will apply prospectively and we will provide notice when required by applicable law.

9. Your Content

Adultify may allow you to submit responses, notes, profile information, feedback, or other content ("User Content").

You retain ownership of your User Content.

By providing User Content through Adultify, you grant Empathy Labs, Inc. a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, analyze, and otherwise use that content as reasonably necessary to:

Operate the Services
Provide features you request
Personalize your experience
Generate assessments, recommendations, and other outputs
Maintain and secure Adultify
Improve Adultify
Perform analytics and research consistent with our Privacy Policy
Comply with applicable law

This license lasts only for as long as reasonably necessary for these purposes, subject to our data retention practices and applicable law.

We may use information that has been aggregated or de-identified so that it no longer reasonably identifies you or your child for analytics, research, product development, and improvement.

You are responsible for User Content you submit and agree not to submit content that you do not have the right to provide.

10. Feedback

If you provide ideas, suggestions, comments, or other feedback about Adultify, you give us permission to use that feedback without restriction or compensation to you.

This does not give us ownership of personal information or other User Content you provide through ordinary use of Adultify.

11. Acceptable Use

You agree not to:

Use Adultify for unlawful or fraudulent purposes
Attempt to gain unauthorized access to another person's account
Interfere with or disrupt the Services or their infrastructure
Introduce malware, viruses, or harmful code
Attempt to bypass security or access controls
Scrape, crawl, harvest, or automatically extract data from Adultify except with our written permission
Reverse engineer, decompile, or attempt to discover Adultify's source code except where applicable law expressly permits it
Copy or reproduce Adultify's content for commercial purposes without permission
Use Adultify to develop, train, or improve a competing product or service
Misrepresent your identity or relationship to a child
Submit content that violates another person's intellectual property, privacy, or other rights
Use the Services in a manner that could damage, disable, overburden, or impair Adultify

We may investigate suspected violations and restrict or terminate access where appropriate.

12. Adultify Content and Intellectual Property

Adultify and its associated software, designs, interfaces, questions, scoring systems, methodologies, graphics, text, branding, trademarks, logos, and other content are owned by Empathy Labs, Inc. or its licensors and are protected by intellectual property laws.

Except for the limited rights necessary to use Adultify as intended, these Terms do not grant you ownership of Adultify or its intellectual property.

You may use Adultify only for your personal, noncommercial use unless we expressly agree otherwise.

13. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use Adultify for its intended purposes.

The Adultify mobile application is licensed, not sold.

For applications downloaded through Apple's App Store, your use of the application is also subject to Apple's applicable terms, including Apple's Licensed Application End User License Agreement unless a different applicable license agreement is presented to you.

14. Third-Party Services

Adultify relies on third-party products and services that may include cloud hosting, authentication, analytics, payment processing, advertising, artificial intelligence, communications, and other infrastructure.

These services may include providers such as Google/Firebase, Stripe, Meta, OpenAI, Anthropic, and others.

Your use of certain third-party services may also be subject to those providers' terms and policies.

We are not responsible for third-party products or services that we do not control, except to the extent required by applicable law.

15. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect personal information.

By using Adultify, you acknowledge that information will be handled as described in our Privacy Policy.

The Privacy Policy is available through Adultify and at our website.

16. Service Changes and Availability

Adultify is an evolving service.

We may add, modify, remove, or discontinue features or content from time to time.

We do not guarantee that:

Every feature will always be available
Adultify will operate without interruption
Adultify will be free from errors or technical issues
Particular content, questions, assessments, or recommendations will remain available
Adultify will work with every device or operating system

We may perform maintenance, install updates, modify features, or temporarily restrict access to the Services.

If we discontinue a paid service, we will handle existing subscriptions as required by applicable law.

17. Account Termination and Deletion

You may stop using Adultify at any time.

You may initiate deletion of your Adultify account through the functionality provided in the app.

We may suspend or terminate your access if you materially violate these Terms, use Adultify unlawfully, create security or safety risks, fail to pay applicable fees, or misuse the Services.

Termination does not affect obligations or rights that by their nature should survive termination, including intellectual property provisions, disclaimers, limitations of liability, and payment obligations already incurred.

Account deletion and data deletion are handled as described in our Privacy Policy.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADULTIFY AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

EMPTHY LABS, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.

WE DO NOT WARRANT THAT ADULTIFY'S QUESTIONS, SCORES, RECOMMENDATIONS, AI-GENERATED CONTENT, EDUCATIONAL CONTENT, OR OTHER OUTPUTS WILL BE ACCURATE, COMPLETE, RELIABLE, OR APPROPRIATE FOR YOUR PARTICULAR CIRCUMSTANCES.

WE DO NOT GUARANTEE ANY PARTICULAR EDUCATIONAL, CAREER, FINANCIAL, HEALTH, DEVELOPMENTAL, RELATIONSHIP, OR LIFE OUTCOME FOR YOU OR YOUR CHILD.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMPATHY LABS, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATING TO YOUR USE OF ADULTIFY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

(A) $100; OR
(B) THE AMOUNT YOU PAID TO ADULTIFY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the legal theory on which a claim is based.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Empathy Labs, Inc. and its officers, directors, employees, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from:

Your material violation of these Terms
Your unlawful use of the Services
User Content you submit in violation of another person's rights
Your fraudulent or intentionally wrongful conduct

This section does not require you to indemnify us for our own negligence, misconduct, or violations of law where such an obligation would be prohibited.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.

To the extent a dispute is permitted to be subject to a contractual choice of forum, disputes arising from these Terms or Adultify will be resolved in the state or federal courts located in Delaware, and you and Empathy Labs, Inc. consent to their jurisdiction.

However, these Terms do not deprive you of any mandatory consumer protections or rights that apply to you under the laws of your state of residence and cannot legally be waived by contract.

Nothing in these Terms prevents either party from bringing an eligible claim in small claims court.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes to Adultify, our business, or applicable law.

When we update the Terms, we will revise the "Last Updated" date above.

If we make material changes, we may provide additional notice through Adultify, by email, or through another reasonable method.

If applicable law requires your consent to a material change, we will request it.

Your continued use of Adultify after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

23. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or similar transaction.

These Terms, together with our Privacy Policy and any additional terms presented to you for a particular feature or purchase, constitute the agreement between you and Empathy Labs, Inc. concerning your use of the Services.

24. Apple App Store

If you download Adultify through Apple's App Store, you acknowledge that:

These Terms are between you and Empathy Labs, Inc., not Apple.
Empathy Labs, Inc., not Apple, is responsible for Adultify and its content.
Apple has no obligation to provide maintenance or support for Adultify.
To the extent Adultify fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid for the Adultify application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to Adultify. Empathy Labs, Inc. is solely responsible for any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to an applicable warranty.
Your license to use Adultify is limited to a non-transferable license to use the application on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that Adultify may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where applicable.
You must comply with applicable third-party terms when using Adultify.
Empathy Labs, Inc., not Apple, is responsible for addressing any claims relating to Adultify or your possession or use of Adultify, including product liability claims, claims that Adultify fails to comply with applicable legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws. If a third party claims that Adultify or your possession or use of Adultify infringes that third party’s intellectual property rights, Empathy Labs, Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that intellectual property infringement claim.
You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as supporting terrorism and that you are not listed on a U.S. government prohibited or restricted-party list.
Apple and its subsidiaries are third-party beneficiaries of the provisions applicable to your use of Adultify on Apple products and may enforce those applicable provisions against you.

Nothing in these Terms is intended to conflict with Apple's applicable App Store terms.
